The Supreme Court of Appeal has recently dismissed an appeal regarding the revival of a lapsed contract due to non-fulfilment of suspensive conditions. The ruling, issued in January 2025, states that such contracts cannot be reinstated. Instead, the parties involved must enter into a new agreement if they wish to continue.
This decision may have significant implications for contractual relationships.
