MOVING CLOSER TO ONLINE PROPERTY TRANSFERS

Further steps have been implemented towards preparing for the electronic registration of property transfers as further sections to the Electronic Deeds Registration Systems Act, 2019 will come into operation on 1 April 2025. The Minister for Land Reform and Rural Development published the commencement date of further sections to the Act on 14 March 2025.

The commencement of these sections will ensure that an electronic title deed is for all purposes deemed to be the only original and valid record once the system becomes fully operational.

These provisions also provide that the Registrar must continue with the registration, execution and filing of deeds and documents as prescribed by the Deeds Registries Act and the Sectional Titles Act, until the electronic deeds registration system or related provisions or regulations are in place, whereafter the registration, execution and filing procedures in terms of the Deeds

Registries Act and the Sectional Titles Act will be discontinued in respect of all deeds, documents or deeds registries.

The promulgation of regulations to implement the system is awaited.
